Terms of Service

1. Who we are
ChipIn ("we", "us", "our") provides a hosted bill-splitting service at chipinpay.app. By creating an account or joining a ChipIn as a guest, you agree to these Terms.
2. What ChipIn does
ChipIn lets a host scan a receipt from a restaurant, cafe, bar, or shop, share it with diners via a link or QR code, and let each diner claim their items so everyone settles their fair share. Card processing, where available, is provided by a third-party payment processor — we don't hold funds.
3. Your account
You must be at least 15 years old to use ChipIn (mirroring our Privacy Policy, which follows OAIC guidance on minors' capacity to consent to data handling). You're responsible for keeping your sign-in email secure and for activity that happens under your account. Guest sessions are tied to a single device and ChipIn; they expire when the bill is settled.
4. Acceptable use
- Don't use ChipIn for fraud, money-laundering, or any unlawful purpose.
- Don't upload receipts containing other people's private data without consent.
- Don't attempt to break, probe, or overload the service.
- Don't impersonate another person when joining a ChipIn.
5. Payments and refunds
When card payments are enabled, you authorise our payment partner to charge the amount shown for your share, plus any disclosed processing fees. Day-to-day refunds for incorrect charges are typically actioned by the host who created the ChipIn — they're the one who knows what was ordered — and the payment partner's own terms also apply. This does not limit any right or remedy you have against ChipIn itself under the Australian Consumer Law where we are the supplier of the service to you. Nothing in this section excludes or limits any non-excludable right you have to a refund, repair or replacement under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
6. Your content
You keep ownership of the receipts, names, and notes you put into ChipIn. You grant us a limited licence to store and display that content so the service can function (showing the bill to your diners, OCR processing, generating totals).
7. Service availability and consumer guarantees
ChipIn is provided on an "as is" and "as available" basis. We work hard to keep the service up but we don't guarantee uninterrupted availability, and — subject to the Australian Consumer Law section below — we're not liable for losses arising from downtime, OCR mistakes, or third-party payment failures.
Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the ACL or any other law that cannot be lawfully excluded or limited. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee in relation to services, we limit it (at our option) to: (a) re-supplying the services; or (b) paying the cost of having the services re-supplied.
Liability cap. Subject to the ACL and any other law we cannot lawfully exclude, and to the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with the service in any 12-month period is capped at the greater of (i) the fees you actually paid us in that period, or (ii) AUD $100. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data. None of these limitations apply where they would be void, prohibited or unenforceable under the ACL or any other applicable consumer-protection law.
8. Termination
You can delete your account at any time from Settings. We can suspend or terminate accounts that breach these Terms or put the service or other users at risk.
9. Changes
We may update these Terms as ChipIn evolves. Material changes will be announced in-app at least 14 days before they take effect. Continued use after the effective date means you accept the new Terms.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and ChipIn submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. If you are a consumer, this clause does not deprive you of the protection of any mandatory law of the jurisdiction where you usually live.
